# TERMS OF SERVICE

## 1. About these terms
These Terms of Service apply to purchases made from JongMan through https://jongman.co.za.

These terms must be read together with our Shipping Policy, Returns & Refunds Policy, Privacy Policy and any product-specific instructions or safety information.

## 2. South Africa only
JongMan operates and delivers within South Africa only. Orders requiring delivery outside South Africa are not accepted.

## 3. Product information
We aim to describe Pompie and its included accessories accurately.

Pompie is a 4-in-1 roadside backup device combining a 12V jump starter, tyre inflator, emergency light and USB power bank. It is intended for supported 12V vehicles and is not intended for 24V systems or large commercial vehicles.

Customers must follow the supplied instructions, safety guidance and product limitations.

## 4. Pricing and payment
Prices displayed on the website are stated in South African Rand (ZAR).

The price payable is the price shown and accepted at checkout, subject to correction of an obvious pricing or technical error where permitted by law.

Available payment methods are those shown at checkout.

Shipping within South Africa is free unless the website expressly states otherwise before the order is placed.

## 5. Orders
An order is subject to acceptance by JongMan.

We may decline or cancel an order where reasonably necessary, including in cases of suspected fraud, payment failure, stock unavailability, an obvious pricing error, or where the delivery address falls outside South Africa.

If we cancel an order after payment has been received and no lawful deduction applies, the amount due will be refunded.

## 6. Delivery
Orders are delivered using Aramex Store-to-Door.

Estimated delivery is approximately 8–11 business days. Remote or outlying areas may take longer, although we aim to remain within the same estimated timeframe.

Delivery estimates are not guarantees where delays arise from circumstances outside JongMan's reasonable control.

## 7. Returns, refunds and statutory rights
Returns and refunds are governed by our Returns & Refunds Policy and applicable South African law.

Nothing in these Terms excludes, limits or waives any consumer right that cannot lawfully be excluded, including rights under the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.

## 8. Statutory product guarantee
Pompie is sold with the guarantees required by applicable South African law. JongMan does not offer an additional voluntary warranty beyond those statutory rights unless expressly stated in writing.

Under applicable consumer law, qualifying defective goods may give rise to statutory remedies including repair, replacement or refund.

## 9. Misuse and damage not caused by a product defect
To the extent permitted by law, JongMan is not responsible for damage, malfunction, loss or injury caused by circumstances unrelated to a defect in the product, including:

- misuse or abuse;
- ignoring supplied instructions or safety guidance;
- reverse-polarity connection;
- use on 24V systems;
- use outside the product's intended or supported application;
- unauthorised opening, repair or modification;
- water ingress where the product is not represented as waterproof;
- impact, crushing or accidental damage;
- clearly improper charging practices;
- incompatible third-party accessories or equipment;
- unreasonable failure to store or maintain the product correctly;
- normal wear and tear; or
- use after the product has been visibly damaged or where continued use would clearly be unsafe.

Nothing in this clause excludes liability or consumer rights that cannot legally be excluded.

## 10. Roadside AI
Pompie Roadside AI provides digital guidance for Pompie setup, troubleshooting and common roadside situations during the applicable access period.

Roadside AI:

- requires compatible internet or mobile connectivity;
- is a digital guidance service only;
- does not replace professional roadside assistance;
- does not replace a qualified mechanic or professional diagnosis;
- does not replace emergency services;
- cannot physically inspect the vehicle, road conditions or surrounding environment; and
- should not be relied upon where there is an immediate risk to life, safety or property.

Serious faults, dangerous situations and emergencies should be handled by the appropriate professional or emergency service.

Pompie itself operates independently of Roadside AI.

Any complimentary access period is subject to the offer stated at the time of purchase. No automatic renewal applies unless the customer separately agrees to one.

## 11. Safety
The customer is responsible for using Pompie reasonably, safely and in accordance with the supplied instructions.

Do not use Pompie where doing so would create an unsafe situation. If a vehicle has serious mechanical or electrical damage, a fuel leak, fire risk, collision damage or another dangerous condition, seek professional assistance.

## 12. Limitation of liability
To the maximum extent permitted by South African law, JongMan will not be liable for indirect, incidental or consequential loss arising solely from misuse of the product, use contrary to instructions, or circumstances beyond JongMan's reasonable control.

This clause does not exclude or limit liability where South African law prohibits such exclusion or limitation.

## 13. Intellectual property
The JongMan name and logo, Pompie name and logo, original product photography, website design elements, graphics, written content and other original material on the website are owned by or licensed to JongMan.

They may not be copied, reproduced, republished, adapted, distributed or used commercially without prior written permission, except where permitted by law.

## 14. Privacy
Personal information is handled in accordance with our Privacy Policy and applicable South African privacy law.

## 15. Electronic transactions
Customers must be given the opportunity to review and correct order information before finally submitting an online order.

Where applicable, consumers retain the rights provided by the Electronic Communications and Transactions Act 25 of 2002, including applicable cooling-off rights.

## 16. Governing law
These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and the rights available to consumers through the courts, the National Consumer Commission, the Consumer Goods and Services Ombud where applicable, or another competent body.

## 17. Changes to these terms
JongMan may update these Terms from time to time. The version applicable to an order is the version made available at the time the order was placed, subject to any rights that apply by law.
